पति-पत्नी के बीच पैसा Transfer करने पर Income Tax लगेगा? पति-पत्नी के बीच money transfer, gift और उससे होने वाली income का tax treatment एक जैसा नहीं होता। Transfer itself और उस transfer से generated income के बीच का अंतर समझना सबसे जरूरी है। इस guide में आप आसान भाषा और examples के साथ समझेंगे कि कब tax लगता है, कब नहीं लगता, नए Income-tax Act, 2025 में कौन-सा section लागू है, और कौन-से documents हमेशा तैयार रखने चाहिए।

नया कानून (2026 Update): 1 April 2026 से Income-tax Act, 2025 लागू है (Tax Year 2026-27 से)। Spouse वाला Clubbing Rule अब Section 99(1)(a)(ii) में है (पुराना Section 64(1)(iv)) और gift taxation Section 92(2)(m) में है (पुराना Section 56(2)(x))। मूल सिद्धांत वही हैं।

परिचय: spouse-to-spouse transfer को लेकर confusion क्यों होता है?

कई परिवारों में पति-पत्नी के बीच savings, household expenses, investments या financial planning के लिए नियमित transfer होते हैं। इसलिए केवल bank statement में transfer दिखना और उस transfer से taxable income बनना दो अलग बातें हैं।

Spouse को किया गया genuine gift सामान्यतः gift receipt के रूप में तुरंत taxable नहीं माना जाता, लेकिन बाद में उस money से होने वाली interest income, investment income या asset income पर Clubbing Rule का analysis जरूरी हो सकता है।

  • पहला सवाल: पैसा किसने transfer किया और source of funds क्या है?
  • दूसरा सवाल: transfer के बाद कौन-सी income उत्पन्न हुई?
  • तीसरा सवाल: income किस spouse के ITR में report होनी चाहिए?

इन प्रश्नों का उत्तर documents, transaction trail और उस समय लागू Income Tax provisions देखकर दिया जाना चाहिए।

क्या पति-पत्नी के बीच Gift पर तुरंत Income Tax लगता है?

Income Tax gift provisions [पुराना Section 56(2)(x) / नया Section 92(2)(m)] के अनुसार spouse 'relative' की श्रेणी में आता है। इसलिए spouse को किया गया genuine gift केवल receipt के आधार पर सामान्यतः taxable income नहीं माना जाता। फिर भी इसे automatic exemption की तरह न समझें; transaction की वास्तविक प्रकृति और applicable law महत्वपूर्ण हैं।

Gift या transfer के लिए निम्न records सुरक्षित रखना उपयोगी है:

  • Transfer की date, amount और bank reference number
  • Transferor का source of funds और bank statement
  • Gift letter, confirmation या अन्य supporting documentation
  • Money के उपयोग और आगे के investment की transaction trail

Practical point: स्पष्ट documentation यह दिखाने में मदद करता है कि transaction genuine था और unexplained credit या artificial routing नहीं था।

Clubbing Rule क्या कहता है? पुराना Section 64(1)(iv) और नया Section 99(1)(a)(ii)

यदि कोई individual अपने spouse को asset सीधे या indirectly transfer करता है और transfer पर्याप्त consideration के बिना या inadequate consideration पर हुआ है (और यह पति-पत्नी के अलग रहने के agreement के तहत नहीं हुआ), तो उस asset से उत्पन्न income कुछ परिस्थितियों में transferor की total income में club हो सकती है।

सरल भाषा में, केवल यह देखना पर्याप्त नहीं है कि income spouse के bank account में आई। यह भी देखना होगा कि income-generating asset या money मूल रूप से किससे आया, transfer किन शर्तों पर हुआ और Section 64(1)(iv) / नया Section 99 की conditions facts पर लागू होती हैं या नहीं।

Clubbing Rule का उद्देश्य income को केवल spouse के account में route करके tax treatment बदलने से रोकना है। इसका practical effect यह हो सकता है कि income recipient के account में दिखने के बावजूद tax computation transferor के hands में करनी पड़े।

याद रखें

Spouse को gift receipt और gift से उत्पन्न income का tax treatment अलग-अलग questions हैं। Gift receipt पर tax न होने का अर्थ यह नहीं कि उससे हुई interest income पर Clubbing Rule कभी लागू नहीं होगा।

House property का special rule: अगर spouse को house property ही बिना पर्याप्त consideration के transfer की गई है, तो transferor को ही उस property का deemed owner माना जाता है (पुराना Section 27(i) / नया Section 25(a)) — यानी rent income transferor के hands में tax होगी।

Transferred पैसे से होने वाली Income (Interest, FD, Investment) पर Tax — Examples के साथ

नीचे दिए गए amounts केवल illustrative examples हैं, tax advice नहीं। प्रत्येक case में source of funds, ownership, transfer terms और applicable provisions की समीक्षा जरूरी है।

Scenarioक्या हुआ?Practical tax focus
(a) Savings या FD interestपति ने पत्नी को ₹5,00,000 gift किए, पत्नी ने 7% की FD कराई और साल में ₹35,000 interest मिला।Transfer बिना consideration (gift) था, इसलिए ₹35,000 interest सामान्यतः पति की total income में club होगा — भले FD पत्नी के नाम हो।
(b) Investment incomeपत्नी ने उसी money से investment किया और interest, dividend या अन्य income earned हुई।Income का exact source और Section 64(1)(iv) / नया Section 99 की applicability check करें; recipient account alone निर्णायक नहीं है।
(c) Asset purchaseTransferred money से asset खरीदा गया और बाद में rent, interest या अन्य income हुई।Asset trail, ownership और income की nature देखकर clubbing और ITR reporting तय की जानी चाहिए।

Second-generation income पर सावधानी: ऊपर के example में ₹35,000 interest पति की income में club होगा। लेकिन अगर पत्नी यही ₹35,000 दोबारा invest करती है, तो उस पर मिलने वाली आगे की income (income on income) को judicial precedents के अनुसार सामान्यतः club नहीं किया जाता। Facts, nature of asset या income और applicable provisions के आधार पर अलग analysis आवश्यक हो सकता है।

कब Clubbing लागू नहीं होता? मुख्य Exceptions

Clubbing का analysis निम्न circumstances में अलग हो सकता है, लेकिन कोई भी exception automatic नहीं है:

  • Adequate consideration दिया गया हो या genuine commercial arrangement मौजूद हो।
  • Transfer पति-पत्नी के अलग रहने के agreement (agreement to live apart) के तहत किया गया हो।
  • Transfer शादी से पहले हुआ हो, या income बनते समय पति-पत्नी का relationship न रहा हो (जैसे divorce के बाद)।
  • Asset वास्तव में spouse के independent funds से खरीदा गया हो और उसका documentary trail उपलब्ध हो।

हर exception के लिए documentary evidence और उस समय लागू law की review जरूरी है। केवल bank narration, informal understanding या account ownership के आधार पर blanket exemption claim न करें।

  1. Transfer को तुरंत taxable मान लेना, बिना यह देखे कि taxable income वास्तव में generate हुई या नहीं।
